General:
The general terms and conditions are the basis for a fair customer relationship. When submitting an order, the customer agrees to the general terms and conditions. We do everything we can to serve our customers to their needs and to their full satisfaction. So that the general terms and conditions remain legible, we use the masculine form, but of course we are also aimed at female customers.
Scope:
The entire range of Shewine GmbH is aimed exclusively at customers within Switzerland and the Principality of Liechtenstein. Deliveries abroad are only possible after prior consultation.
Privacy:
We do not deal with your personal information. Only those are recorded that are necessary to process your order and simplify the handling of the online shop for returning customers. Personal customer data is treated confidentially in accordance with data protection legislation and is neither passed on to third parties nor used for third-party advertising. All personal data (in particular information when paying by credit card) is transmitted in encrypted form.
No sale to minors
According to legal regulations, wines may not be sold to young people under the age of 16 in Switzerland, and spirits may not be sold to minors under the age of 18.
By placing an order on www.shewine.ch, the customer confirms the correctness of his information and thus his authorization to shop.
Prices:
All prices are per item in Swiss Francs (CHF) including statutory VAT. The same applies to the listed transport costs. Shewine GmbH reserves the right to make price changes. Such price changes have no effect on goods that have already been ordered. The customer pays for the goods ordered either by invoice or using the credit card he has chosen by releasing the amount for payment via the Internet in the input window provided for this purpose. Price changes and time-limited promotions are possible at any time and do not require notification.
Payment terms:
We reserve the right to deliver to new customers or customers with poor payment behavior only against prepayment by bank transfer or payment by credit card. In addition to cash payments (in the shop), we also accept the following credit and debit cards: Maestro, Postcard, MasterCard and Visa.
The invoice is due immediately and must be paid no later than ten days after acceptance of the goods by the customer or his representative. Any cash discounts and / or the like will be charged to the customer subsequently. When buying in advance, the desired order is only triggered when the corresponding payment has been received. The items in the order cannot be reserved. If Shewine GmbH does not receive payment within ten days, the order can be canceled.
Retention of title and right of withdrawal:
The goods remain property of Shewine GmbH until they have been paid for in full. In the event of default in payment, we are entitled to withdraw from the purchase contract. We reserve the right to register the retention of title with the competent authority. Default interest of 5% will be charged for late payments. Reminder fees from the 2nd reminder onwards will be charged with a flat rate of CHF 25.00.
Delivery:
In principle, the ordered goods are delivered on our behalf by Vinolog, Camion or Post, the following cost regulations:
From an order value of CHF 500.00 or an order quantity of at least 48 bottles, delivery is free throughout Switzerland. We charge as follows:
– We charge CHF 14.00 for deliveries up to and including 6 bottles
– We charge CHF 18.00 for deliveries of 7 to 12 bottles
– We charge CHF 25.00 for deliveries of 13 to 48 bottles
For destinations that cause additional work (car-free areas, connection via mountain railways, etc.), the additional costs will be passed on.
Warranty:
Basically, faultless, purchased products can neither be taken back nor exchanged by the seller. If, as an exception, the customer does not like the purchased wine, contrary to expectations, unopened bottles can be exchanged for proof of purchase for three months from the date of purchase and if handled and stored properly. A reimbursement is excluded.
Complaints / cork wines
Faulty wines, e.g. with a «cone flavor», will be reimbursed on presentation of the receipt, provided the fault can be identified and the bottle is at least 75 percent full and the date of purchase is no more than 6 months ago. The bottles are to be delivered to us carriage paid or to be handed in to the store. Unfortunately, rare wines cannot be replaced or reimbursed.
Defects:
The condition of the goods received must be checked immediately upon receipt.
After eight days, the delivery is considered approved.
Sale to minors:
Shewine does not sell alcohol to minors under the age of 18. By placing an order on www.shewine.ch, the new customer confirms the correctness of his information and thus his authorization to shop.
General availability:
Our range (products, vintages, etc.) is subject to constant change. The right to make short-term changes to the range and / or vintage is reserved. A complete and constant availability of our offer on www.shewine.ch can therefore not be guaranteed. Limited available articles including rarities.
Our range also includes limited availability wines and spirits or items where demand exceeds supply. On the one hand, this means an upgrading of our range, on the other hand, this shortage can make it more difficult to allocate such wines to our customers. It is our job and our policy to distribute the money across Switzerland in the fairest possible, non-speculative manner. We also have to meet the requirements of the producers (product mix). We ask for your understanding.
Place of jurisdiction:
For disputes, differences of opinion or claims arising from or in connection with the contractual relationship between the customer and the seller, including its validity, invalidity, infringement or dissolution, the relevant courts at the seller’s registered office are responsible. Swiss law is the applicable law.
Validity:
These terms and conditions can be changed at any time and without prior notice.
